Al Faisal Silver — Terms and Conditions

1. General
These Terms and Conditions govern your access to and use of the Al Faisal Silver website at http://www.faisalkw.com (the "Website"), including the products, services, and related features offered by Al Faisal Silver ("we", "us", or "our").
By accessing the Website, creating an account, placing an order, or using any of our products or services, you agree to be bound by these Terms and Conditions. If you do not agree with these Terms and Conditions, you should discontinue use of the Website.
Al Faisal Silver reserves the right to amend or update these Terms and Conditions from time to time. Any changes will become effective once they are published on the Website. Customers are responsible for reviewing the Terms and Conditions whenever they use the Website.
2. Account and Registered Users
Certain features of the Website, including ordering and purchasing products, may require you to create an account secured by a password (the "Account"). Your Account is personal to you and may not be transferred or assigned to another person.
When creating an Account or using the Website, you confirm that the information you provide is accurate, complete, current, and not misleading. You agree to update your information whenever necessary to ensure that it remains accurate.
You are responsible for maintaining the confidentiality of your Account information and password and for all activity conducted through your Account. If you believe that your Account has been accessed or used without authorization, you must notify Al Faisal Silver immediately.
As a registered customer, you may place orders and purchase products through the Website. You agree to pay the full amount shown during checkout, including any applicable delivery charges, service fees, or other charges disclosed before you submit your order.
All orders placed through the Website are subject to acceptance by Al Faisal Silver. Any order confirmation or acknowledgement confirms that we have received your order and does not necessarily constitute final acceptance of the order.
We may not retain complete order details for future access through the Website. Customers are therefore encouraged to keep copies of their order confirmation, invoice, and these Terms and Conditions for their records.
From time to time, product information, availability, pricing, or order details may contain errors. Al Faisal Silver will make reasonable efforts to correct such errors and may, where appropriate, correct the information, cancel an affected order, or contact the customer to reconfirm the order at the correct price or terms.
3. Products, Pricing, and Availability
Product images, descriptions, specifications, colours, and availability displayed on the Website are provided for general information and guidance. While we make reasonable efforts to ensure that product information is accurate, minor differences may occur due to product updates, supplier changes, screen settings, or availability.
Products are offered subject to availability. If a product becomes unavailable after an order has been placed, Al Faisal Silver will notify the customer as soon as reasonably possible. If payment has already been made for an unavailable product, we will provide an applicable refund.
The price payable for a product is the price displayed on the Website at the time the order is received, subject to the correction of pricing or other errors. All prices are stated in Kuwaiti Dinar (KWD) unless otherwise indicated.
Any applicable delivery charges or additional fees will be displayed before the order is completed.
If a pricing error is discovered after an order has been placed, Al Faisal Silver may contact the customer to confirm the order at the correct price or may cancel the order. If the customer cannot be reached, the order may be treated as cancelled. Where payment has already been made, a refund will be issued for the cancelled order.
4. Payment
Al Faisal Silver may accept payment through debit cards, KNET, Cash on Delivery, Payment on Delivery, or other payment methods made available on the Website from time to time.
Available payment methods may vary depending on the product, order value, delivery area, availability, or other operational considerations.
When using KNET or another online payment method, you may be redirected to the relevant payment gateway to enter your payment details and complete the transaction. Payment authorization and verification are handled by the applicable payment gateway and/or card-issuing bank.
Payment service providers or issuing banks may perform identity, card, or transaction verification checks to help prevent unauthorized transactions. By selecting an online payment method, you consent to such checks being carried out by the relevant payment provider.
Al Faisal Silver handles customer information in accordance with applicable laws and its operational requirements. However, we are not responsible for losses resulting from unauthorized access, fraud, or security breaches involving third-party payment providers, issuing banks, or the customer's own card, PIN, password, device, or account, except where liability cannot legally be excluded.
Risk of loss or damage to products generally passes to the customer upon delivery to the address specified in the confirmed order, or upon the first attempted delivery where the customer or authorized recipient is unavailable, provided that payment has been made or is collected upon delivery, as applicable.
5. Cash on Delivery and Payment on Delivery
Where Cash on Delivery or Payment on Delivery is available, full payment must be made to the authorized delivery representative before the products are handed over.
Upon receipt of payment, the delivery representative will provide the products along with the invoice and/or delivery documentation, where applicable.
Al Faisal Silver does not accept cheques, gift vouchers, or discount coupons as payment upon delivery unless expressly stated otherwise. Any applicable discount or promotional coupon must be applied during checkout.
Products may not be retained by customers on credit. Payment must be completed at the time of delivery.
The person receiving the order should normally be the customer who placed the order or an authorized recipient who can provide reasonable proof of authorization when requested.
If the customer or authorized recipient is unavailable at the delivery location, the delivery representative may wait for a reasonable grace period of up to 20 minutes. If contact cannot be established, another delivery attempt may be made later or on the following day, subject to operational availability.
If Al Faisal Silver's customer service or delivery team is unable to contact the customer within 48 hours after the order is placed, the order may be considered cancelled.
Cash on Delivery or Payment on Delivery may not be available for all products, including certain pre-order, special-order, or other products where the payment method is not displayed during checkout.
6. Delivery
Delivery areas, estimated delivery times, charges, and available delivery methods will be displayed on the Website or communicated during the order process, where applicable.
Delivery timeframes are estimates and may be affected by product availability, customer location, payment verification, public holidays, weather conditions, traffic, logistics issues, or other circumstances beyond our reasonable control.
Customers are responsible for providing complete and accurate delivery information, including their full name, mobile number, address, building details, and any relevant delivery instructions.
Al Faisal Silver is not responsible for delays, failed deliveries, additional delivery charges, or other issues caused by incorrect, incomplete, or outdated information provided by the customer.
7. Returns and Exchanges
Customers may request a return, exchange, replacement, or refund for eligible products within fourteen (14) days from the date of purchase, subject to submission of the original invoice and compliance with the applicable return conditions.
The product, together with all accessories, packaging, cartons, manuals, and related items, must be new, unused, unopened, unwrapped, undamaged, in resalable condition, and in substantially the same condition as when purchased.
Alternatively, a return or replacement may be considered where an authorized repair or service center confirms that the product has a manufacturing defect, technical malfunction, or does not conform to applicable standards and specifications in the State of Kuwait.
Returns, exchanges, replacements, or refunds may be refused where products are used, damaged, incomplete, altered, missing accessories or packaging, opened in a manner that affects resaleability or hygiene, or otherwise do not meet the applicable requirements of these Terms and Conditions or applicable law.
Approved refunds will generally be processed using the original payment method where reasonably possible. An alternative refund method may be used where required due to operational, legal, or technical circumstances.
8. Warranty Coverage
Products sold through the Website may be covered by the applicable manufacturer's and/or authorized distributor's warranty, where available.
Warranty periods, coverage, service procedures, and exclusions vary depending on the product, brand, manufacturer, and supplier.
Unless otherwise required by applicable law, warranty coverage does not normally extend to damage resulting from misuse, accidents, unauthorized repairs or modifications, liquid damage, improper installation, physical damage, normal wear and tear, or use contrary to the manufacturer's instructions.
Al Faisal Silver is committed to providing genuine products. If a product purchased from Al Faisal Silver is verified, through the company's verification procedures, to be counterfeit or inauthentic, the customer will be entitled to an applicable return and refund in accordance with this policy and applicable law.
9. Pre-Orders and Special Orders
Certain products may be offered as pre-order, limited-stock, or special-order items.
Estimated availability, release, or delivery dates for such products are provided for guidance only and may change due to supplier availability, shipping delays, customs procedures, or other logistical circumstances beyond our reasonable control.
Cash on Delivery or Payment on Delivery may not be available for certain pre-order or special-order products unless expressly stated during checkout.
10. Customer Responsibilities
Customers agree not to:
• Submit false, misleading, or fraudulent information.
• Interfere with the operation, security, or functionality of the Website.
• Attempt to obtain unauthorized access to any account, system, network, or service.
• Use another person's Account without proper authorization.
• Use the Website for any unlawful, abusive, fraudulent, or prohibited purpose.
Customers are responsible for ensuring that any product purchased is suitable for its intended purpose and compatible with their devices, systems, or specific requirements before completing the purchase.
Al Faisal Silver's customer service team may provide general product information or assistance where possible; however, the final purchasing decision remains the responsibility of the customer.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Al Faisal Silver's total liability relating to any product, order, or transaction shall be limited to the amount actually paid for the product concerned.
To the extent permitted by law, Al Faisal Silver shall not be liable for indirect, incidental, special, consequential, or punitive losses or damages, including loss of profits, loss of business, business interruption, loss of data, or damages resulting from improper use of products.
Nothing in these Terms and Conditions excludes or limits any liability that cannot lawfully be excluded or limited under the laws of the State of Kuwait.
12. Privacy and Communications
Al Faisal Silver may use the information provided by customers to process and fulfill orders, arrange deliveries, provide customer support, verify payments, improve products and services, and communicate with customers regarding orders, warranties, promotions, or account-related matters.
We may contact customers through telephone calls, SMS, WhatsApp, email, or other communication channels provided by the customer where reasonably necessary.
Customer personal information will be handled in accordance with applicable laws and Al Faisal Silver's privacy practices.
Al Faisal Silver will never request a customer's card PIN, banking password, OTP, or other sensitive payment credentials through telephone calls, SMS, WhatsApp, or email. Customers should never disclose such information to anyone claiming to represent the company.
13. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of Kuwait.
Any dispute, claim, or matter arising from or relating to these Terms and Conditions, the Website, or any transaction conducted through the Website shall be subject to the jurisdiction of the competent courts and authorities of the State of Kuwait, unless otherwise required by applicable law.
